General Trading and Delivery Terms of Flying-Arrow Archery Center owned by “Samui Archery Company”

By accessing Flying-Arrow Online Shop via www.flying-arrow.shop, you confirm that you will have read, agreed, verified and acknowledged all the conditions related to our waivers and disclaimers below:

• You are at least 18 years of age.

• All sales transactions are completed in Thailand under Thai-law and regulations.

• If there is any dispute about or involving Flying-Arrow products, you agree that the dispute shall be governed by the laws of Thailand, without regard to conflict of law provisions and you agree to exclusive personal jurisdiction and venue in Thailand.

• Buyer assumes full responsibility of all liabilities, damages, injuries, modifications done to products purchased by Flying-Arrow

• You will not hold Flying-Arrow, its owners, members, affiliates, or employees responsible for any legal actions, liabilities, damages, penalties, claims, or other obligations caused by your ownership of products purchased by Flying-Arrow

• You acknowledge that the export of certain products sold by Flying-Arrow may be prohibited by national or international regulations. You agree that you will not unlawfully import or export any prohibited or restricted items.

1. General shop information

Every incoming order will be dealt with as soon as possible. The delivery time depends on the ordered articles and their availability. Items in stock are shipped the next day. Imported goods usually have a delivery time of 7-14 days or up to a maximum of 30 days.

2. Shipping of goods

We ship our products worldwide to specific countries. Domestic shipping is usually done with EMS Thailand Post, for international shipping we use DHL or FEDEX. When shipping internationally, transport insurance is generally taken out, which is included in the shipping costs. Partial deliveries can also be made upon agreement with the customer.

3. Shipping of goods to other countries

There may be special import regulations for our products in other countries. It is the responsibility of the importer (customer) to clarify how the goods can be imported and cleared through customs. If an import permit is required, we recommend obtaining it before ordering. From our side, we will ship the goods legally declared as “sporting goods” with the corresponding customs tariff code. Customs clearance is usually handled by the shipping company (DHL, FEDEX)

4. Return of goods

To Thailand imported goods and goods manufactured according to customer specifications cannot be returned. Goods delivered abroad cannot be returned either. Other items can only be returned within five working days after receipt provided prior notice has been given by telephone and the return postage is paid. In addition, we reserve the right to charge for the decrease in value.

5. Payment and additional fees

The options to pay for the goods are displayed on the checkout page. We accept Thai QR-PromptPay, bank transfer and credit cards. For credit cards we charge a 4% fee and in general the purchase amount must be at least 1,000 THB and cannot exceed 100,000 THB.

6. Domestic orders

We ship goods  free of charge throughout Thailand. For imported goods, fees for import licenses, customs clearance and taxes are included in our selling prices.

7. International orders

International orders include additional shipping costs which are paid using “shipping vouchers”. The vouchers are available in the store in increments of 500 THB or 1,000 THB. For example, if the shipping cost is 1,500 THB, the customer purchases 1x voucher 500 THB and 1x voucher 1,000 THB / or 3x vouchers 500 THB. International shipping costs will be communicated to the customer by email when the order is processed.

8. Jurisdiction and place of fulfilment

The place of jurisdiction and of fulfilment for both parties is Thailand.

9. Product liability and warranty

Our products are subject to the manufacturer’s product liability. Warranty cases and repairs are carried out in their repair centers or here in the Flying-Arrow Archery Center. The warranty period varies between brands; they are specified in detail in the product description. In a legitimate warranty case, the manufacturer decides whether the product will be repaired or replaced.

10. Complaint in case of defective goods upon delivery

If the goods have been delivered and there is visible damage to the packaging or the goods, this must be reported within 24 hours with photo or video evidence. After confirmation by a Flying-Arrow representative, the goods must be returned in the original packaging. If the packaging has been opened and the goods have been used, any warranty claim will be void.
